Commercial Litigation
COMMERCIAL LITIGATION focuses on resolving financial and business disputes between individuals and businesses. We assess the merits of a dispute and either develop a prosecution or defense, depending on the situation our client is involved in, to meet the client's legal needs.
General commercial litigation involves practically every type of financial or business dispute, including breach of contract cases, shareholder/ partnership/joint venture disputes, construction claims, trade secret and unfair competition, intellectual property infringement, real estate and land use litigation, non-compete agreement disagreements, business torts, and breach of fiduciary duty allegations, to name a few.
Commercial litigation generally progresses at the following stages: retaining an attorney, conducting factual investigations, researching applicable law, directing demand letters, engaging in settlement negotiations, filing suit, conducting discovery, participating in motion practice, trying the case before a judge or jury, filing post-trial motions, and so on.
We furthermore use Arbitration and Mediation to resolve disputes outside of court, which affords more control over the resolution process.
We also focus on pre-litigation counseling and risk prevention with our clients—getting involved even before any dispute has arisen, whether by counseling clients on the ramifications of business decisions or ensuring compliance with laws and regulations.
